When Does an Energy Retailer Become a Larger Retailer under Australia's Consumer Data Right?

As an energy retailer in Australia, you might have heard about the term “larger retailer” in the context of the Consumer Data Right (CDR). This blog will break down what it means and when your business may need to take on new CDR responsibilities as a data holder.

What is a “Larger Retailer”?

Schedule 4, clause 8.3. of the CDR Rules defines a larger retailer in two ways:

  1. On Amendment Day (16 November 2021):
    If, on 16 November 2021, your business had 10,000 or more small customers, you were considered a larger retailer from that day forward.

  2. After the Amendment Day:
    If your business has 10,000 or more small customers at all times during any financial year that begins on or after 16 November 2021, then you become a larger retailer starting 12 months after the end of that financial year. For example, if you had over 10,000 customers for the entire period from 1 July 2023 to 30 June 2024, then you are a larger retailer from 1 July 2025.

Who Counts as a “Small Customer”?

  • Domestic or Small Business Customers:
    These are customers defined under the Electricity Industry Act 2000 (Vic) or the National Energy Retail Law. If you supply energy to households or small businesses, they are generally considered small customers.

Being classified as a larger retailer under the CDR means your business will have extra responsibilities, including:

  • Sharing Customer Data:
    You must securely share data as required by the CDR framework. This helps increase transparency and competition in the energy market.

Since the amendment day was in November 2021, many energy retailers have already reviewed their customer numbers. If your business meets or exceeds the 10,000 small customer threshold, you should already be preparing or may already be complying with these extra obligations.
